The Power of Judges: A Comparative Study of Courts and Democracy (Oxford Socio-Legal Studies), by Carlo Guarnieri, Patrizia Pederzoli

This book argues that three elements affect the political significance of judicial decisions. First is the status of judges (the way they are recruited and the guarantees they enjoy) and the way judges define their role in the judicial and political process. Second is the organization of the judicial system, including the existence of judicial review of legislation, the structure of trials and the arrangement of public prosecution. Thirdly, judicial power is affected by the broader political system: a polity in which power is divided and fragmented offers wider opportunities for the judiciary to intervene in the political process.

Review
These political scientists provide major agendas for inter-disciplinary study of matters about which lawyers, especially comparative lawyers, are much excercised. International and Comparative Law Quarterly It is an invaluable resource for anyone who wants to know the basic facts - no, quite a lot of deep and detailed facts - of the systems in the seven jurisdictions for the purposes of any objective comparison ... Buy this book for the quality of its objective factual research. Journal of Law and Society ... enormously high quality of the factual research ... The comprehensive sweep of the authors' descriptions of judicial careers and systems in the seven jurisdictions is entirely admirable. The use of illustrative tables is particularly well done ... The authors are also to be commended for the thoroughness of their cross-references and bibliography. Journal of Law and Society
